These terms and conditions govern your use of The Memorial Company's website.

By accessing this website, you agree to abide by these terms and conditions. If you do not agree with any part of these terms and conditions, please refrain from using The Memorial Company's website.

The following terms apply to these Terms and Conditions, Privacy Statement, and Disclaimer Notice, as well as any agreements: “Client”, “You”, and “Your” refer to the individual accessing this website and accepting the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our”, and “Us” refer to our Company. “Party”, “Parties”, or “Us” refer to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance, and consideration of payment necessary to facilitate our assistance to the Client in the most suitable manner, whether through formal meetings of a predetermined duration or any other means, with the express purpose of meeting the Client’s needs in relation to the Company’s stated services/products, in accordance with and subject to prevailing law. Any use of the above terminology or other words in the singular, plural, capitalisation, and/or he/she or they are deemed interchangeable and therefore refer to the same.

By agreeing to our Terms & Conditions, you are accepting the following:

  • You assume full responsibility for posting your inclusions to us and acknowledge that if they go missing, The Memorial Company is not liable. We strongly recommend sending inclusions via Special Delivery for peace of mind.

  • Each item is meticulously handcrafted, and colours may vary due to: A) The jewellery setting the stone is cast into. B) The inclusions cast with the colours, such as dark, red, blonde, or grey hair strands, which may reflect differently based on hair colour, pigment, and resin. This also applies to ashes. Due to the wide colour variations of ashes or hair, it can be challenging to predict the final appearance before casting. If you'd like guidance on how your item may look before purchase, please contact us. PLEASE NOTE: White/grey human, horses, or pet hair/fur may become transparent within the resin, as they are often pigment-less. Feel free to contact us for advice if you have any concerns.

  • After purchasing your items, unless stated within the first 12 hours that you wish to: A) Change the ordered item. B) Notify that you ordered the wrong item. We are not obligated to change or refund the items. If you change your mind, we are not obliged to provide a full refund. 

  • The name and address provided on your order upon purchase will be used for shipping. If you need to change these details after processing your order, please message a member of our team for confirmation before assuming the changes will be made. The Memorial Company bears no liability if parcels are sent to the address provided upon ordering without notification of a change of address. Similarly, if parcels are lost by Royal Mail or any other courier service we use, we are not held responsible but will make every effort to track the parcel and seek compensation for you.

  • If we have not received the inclusions required from you upon ordering within 6 weeks (unless shipping from abroad has been delayed), we reserve the right to refuse refunds and to decline further work after this timeframe.

  • Accidental damage to your item does not obligate us to provide a refund or repair. However, we endeavour to assist where possible. This includes damage caused by chemicals such as hand sanitiser and perfume, resulting in cloudy spots in the resin. Such precautions are outlined in the care instructions sent with each item. If your item arrives damaged, we will strive to rectify any issues.

  • We provide an estimated turnaround time of approximately 6 to 8 weeks from the ordering date for each piece. This timeframe may vary due to delays experienced by third parties involved in supplying The Memorial Company Jewellery or transporting them via courier services. By purchasing, you acknowledge that delays may occur at any time, and the given dates are estimates only. Nevertheless, we make every effort to meet deadlines for special occasions.

Sales & Orders

Orders made by you on thememorialcompany.shop (the "Website") for products offered by us through the website constitute an offer to enter into a sales contract. The sales contract becomes effective upon our confirmation of the order via email to you. You, as the individual placing the order ('you', 'your'), must be 18 years or older to enter into a contract with us. By placing an order, you confirm that you meet this age requirement. We supply products for domestic and private use only. This contract is between you and us. No other party shall have the right to enforce any of its terms. Neither party will require the agreement of any other party to terminate the contract or make any changes to these terms. We intend to rely on these purchase terms and conditions, as well as any document expressly referenced in them, regarding the subject matter of any Contract. While we accept responsibility for statements and representations made by us, please ensure that any variations from these terms and conditions are confirmed in writing. Our shopping pages will guide you through the necessary steps to place an order with us. Our order process allows you to review and correct any errors before submitting your order. Please carefully review your order at each stage of the process. Upon placing an order, you will receive an email acknowledgment from us confirming receipt of your order. The Contract between us will only be formed when we send you the Dispatch Confirmation. If a Product is out of stock or we are unable to supply it for any reason, such as inability to verify delivery or payment information provided by you, we will notify you by email and will not process your order. If payment has already been made, we will refund the full amount, including any delivery charges. In cases where we are unable to verify the delivery or payment information provided, we may limit delivery to the address registered to your credit or debit card. We will not be responsible for any fees incurred for reposting if an incorrect delivery address is provided to www.thememorialcompany.shop. We reserve the right to charge a fee for reposting an order/item returned to us due to an incorrect delivery address provided. Additionally, we reserve the right to deduct delivery costs from all orders, including free postage orders, when an incorrect delivery address is provided to www.thememorialcompany.shop.

Payment

We accept PayPal, as well as all major credit and debit cards. Payment is required prior to completing your order. You can make payment using any major prepaid, credit, or debit card, or through an electronic payment account, as detailed on the order form. By placing an order, you authorise payment to be charged to your prepaid/debit/credit card account or electronic payment account as provided on the order form. Payment will be deducted and cleared from your account before the Goods are dispatched to you.

For card payments, we conduct specific checks, including obtaining authorisation from your card issuer to ensure sufficient funds and for security purposes. This may entail verifying your name, address, and other personal information provided by you during the order process against relevant third-party databases, including the card issuer, registered credit reference agencies, and fraud prevention agencies.

By accepting these Conditions, you:

  • Confirm that all details provided to us for purchasing the Goods are accurate, and the payment card used belongs to you, with sufficient funds to cover the cost of the Goods ordered.

  • Agree that any Goods ordered are for your personal or domestic use only and not for resale.

  • Authorise us to transmit the payment and delivery information provided by you during the order process (including any updates) to obtain authorisation from your card issuer, authenticate your identity, validate your payment card, and for security reasons such as fraud prevention.

  • Understand that we will contact you if any issues arise with the authorisation of your card.

  • Acknowledge that we will take all reasonable measures, within our capacity, to keep your order and payment details secure. However, unless due to negligence on our part, we cannot be held responsible for any loss resulting from unauthorised access by a third party to any data you provide when accessing or ordering from our Website.

Returns & Refunds

​

We strive for your satisfaction with your The Memorial Company purchase. However, as each product is custom-made, we can only offer a refund if the piece does not match your order or if it is faulty. In such cases, we will first attempt to resolve the issue by repairing or remaking a brand new piece, depending on the nature of the fault.

Should you encounter any issues as mentioned above, please reach out to us promptly for resolution. We may request photos or the return of the item to assist in addressing the matter, providing guidance tailored to each circumstance.

Refunds for cancellations can be arranged, but only before the commencement of crafting, or the ordering of the jewellery from our suppliers. Kindly inform us at your earliest convenience if you wish to cancel an order.

If you require any changes to your order after placement, please contact us immediately to ascertain if crafting has begun. Once crafting is underway, we may be unable to accommodate amendments.

Warranty 

​

All our pieces are covered by a complimentary 12-month warranty from the date of delivery.

This warranty safeguards your goods against manufacturing faults and ensures they match your order upon receipt. Please note, it does not extend to instances where the consumer has failed to review the complete product details or misunderstood any prior to placing the order.

While our warranty excludes damage resulting from wear and tear or misuse by the consumer, we encourage you to report any faults promptly. Please email comprehensive details of the issue, including your name, order number, and photos, to thememorialco@hotmail.com.

Specifically, our warranty addresses manufacturing faults in the jewellery metal and special resin used in custom-made ashes jewellery, excluding wear and tear like scratches, dents, or broken chains due to tension.

In the event of manufacturing faults, we will initially attempt a repair. Should repair prove unfeasible, we will provide a replacement. However, we reserve the right to decline repair or replacement if evidence of misuse or wear and tear is present.

Please note, the warranty becomes void if the piece has undergone any alterations, repairs, or other interventions by another company or jeweller. Regrettably, we cannot facilitate repairs or replacements for damage caused by external parties.

All claims must be reported within the warranty period. Claims made beyond this timeframe may be subject to chargeable repair or replacement services, contingent upon assessment.

Your satisfaction is our priority, and we endeavour to address any concerns promptly and effectively within the scope of our warranty terms.
